Bad tendency rule
Restraining an action before the activity has occured. It refers usually to censorship.

Advertising statements that are protected by the 1st Amendment.
Commercial Speech
First Amendment section prohibiting the establishment of a church by the national

Establishment Clause
Provision of the 1st Amendment that guarantees the free exercise of religion

Symbolic Speech
Public uttering of statement that harms the good reputation of another.
Slander
Written defamation of character, reputation, or business.
Libel
Boisterous and generally disruptive behavior by an audience that effectively limits the
ability of a speaker to speak.
Heckler's veto
A judge issued order limiting the publication of news about a trial in order to protect the
accused rights to a fair trial.
Gag order
View that most of the protections of the Bill of Rights are applied against the state
governments through the 14th amendment's due process.
Incorporation Theory
A FCC regulation affecting broadcasting present contrasting viewpoints on controversial
issues of public importance.
