Bad-Tendency Rule
test that permits restriction of freedom of speech if it can incite illegal activity
Equal Time Rule
a station must sell equal time to candidates
Prior Restraint
Censorship; government's actions that prevent material from being published
Slander
Spoken defamation; saying something that is not valid about someone else with onlooking third party
Symbolic Speech
Actions that don't consist of speaking or writing but express an opinion (ex. burning a flag; Texas vs. Johnson)
Commercial Speech
Communication in the form of advertising
Establishment Clause
states that Congress cannot tangle/back any religion; wall of separation by Thomas Jefferson
Incorporation Theory
legal concept where Supreme Court nationalized B.o.R by making provisions applicable to 14th amendment
Writ of Habeas Corpus
Court order requiring jailers to explain to a judge why they're holding a prisoner in custody
Heckler's Veto
An acting party's right to freedom of speech is restricted by the government in order to prevent a reacting party's behavior
Gag Order
Court order forbidding public reporting or commentary on a case currently before the court
Clear/Present Danger Test
the ability of government to restrict someone's freedom of speech if it endangers others
Free Exercise Clause
allows citizens' freedom to worship or not to worship as they please (government can't interfere with practice of religion)
Fairness Doctrine
requries that all opposing view points will be given roughly equal time on the air (during debates, etc)
Personal Attack Rule
When a person or small group is subject to a character attack during a broadcast. Stations must give them the opportunity to respond on air
